tonight. i'm maureen umeh. the deal would delay harsh spending cut for two months, but it appears the house will not vote before tonight's midnight deadline. >> we'll continue to work on finding smarter ways to cut spending, but let's not let that hold up protecting americans from the tax hike that will take place. we can do this. we must do this. >> reporter: though it is down to the wire. >> it's december the 31st! january 1st is tomorrow, 2013, taxes go up. >> reporter: a frustrated senator john kuhn said the senate should have acted months ago to keep the economy from going off the fiscal cliff. >> i just find it really hard to sit and listen to people come up now and wring their hands and talk about gee whiz, you know, i really hope we can get something done here in the last day as we put two people together basically to resolve this. >> reporter: the two people were senate republican leader mitch mcconnell and vice president joe biden who worked the phones late last night and

early this morning after talks between mcconnell and majority leader harry reid stalled. >> discussions continued today on a plan to protect middle class families from the tax increase tomorrow. there are a number of issues on which the two sides are still apart, but negotiations are continuing as i speak. >> reporter: the agreement would set the threshold for extending the bush tax cuts at $400,000 for individuals and $450,000 for families. it would set the tax rate our income people at 39.6%, the rate under former president bill clinton. estates would be taxed at 40% above $5 million for individuals and $10 million for a married couple. unemployment benefits would be extended a year, as would the medicare doc fix and it would permanently fix the alternative minimum tax. a big concern for republicans is there are no new spending cuts. >> history has a way of repeating itself. somehow washington never gets the message and here we are 30 years later on the brink of another crisis on new year's

eve still addicted to spending money. >> this has been a long road with a lot of frustration and many people are wondering why it took so long to reach a deal. we're joined now by fox 5 political analyst mark plotkin and mark, as we know, for a bill to become law both houses have to pass. it the house is not voting today. they've gone home. we don't know when the senate will vote. what does this all mean? >> what it means is that mitch mcconnell and joe biden rather than the majority leader harry reid, the minority leader mitch mcconnell, the republican, and the vice president representing the white house have worked out a deal. now i think it will pass the senate. it only needs 51 votes. that means there will be no filibuster and there will probably be no amendments which they have to vote on each amendment. the problem then becomes the house. no bill becomes law unless both houses pass it and so the house will have to pass it. you very well might have a situation where john boehner,

the speaker, the leader of the republicans, will be embarrassed tomorrow because a lot of republicans will vote against it, but as long as they get a majority of the house, which is 218, and 30 or 35 republicans vote with the democrats, the bill will pass and become law and the president will immediately sign it. >> so the details of the deal are still largely unknown. what can you tell us about what in essence they've agreed upon tonight? i know i'm hearing that people on the far right and people on the far left are not happy with this. so it means it must be a compromise deal here. so what can you tell us about the particulars? >> reporter: >> the specifics which were outlined in the package is the president said i'm not going higher than 250,000 all during the campaign and he seems to have gone up to 450,000. the republicans who said we will never vote for a tax increase, we don't care if people are very wealthy, have agreed to vote for a tax

increase, the estate tax which republicans are very concerned about will now be indexed to inflation, the alternative minimum tax, which has gone up and affected more people which was posted just to make sure that millionaires paid their fair share, now more people won't fall under that, so they'll have to pay that. so what you have is both sides in some ways holding their noses because institutionally the congress has decided, both democrats and republican. it's too embarrass and they might face political retaliation by doing nothing. so they're going to vote for a bad deal that maybe both of them think is not what they should be doing, but they want to get done with this. >> and, of course, the debt ceiling, this deal doesn't address that. so we could be fighting this all over again in just a few months, president obama already saying he doesn't want to do this. where does this leave things in our last final seconds? >> yes. we'll have another routine over

that and republicans feel much strengthened by that because they have the leverage and if the debt ceiling is not agreed to, then the credit rating of the united states as a country will go down. the president didn't want to play this game, looks like he's now going to have to play this game. >> and the political near the rancorring continues. >> but happy new year. >> same to you, always a pleasure to see you and we'll see you next year. >> okay. on to much better news, can you believe it? the redskins are nfc east champs. last night's 10 point win over the dallas cowboys was their seventh straight victory, so good-bye 2012, hello 2013 and a trip to the playoffs. we are here with sports director scott smith. you were the good luck charm i'm going to say. you roll into town. this team starts doing well and what a win they had last night, awesome. >> it's good to be here. i don't know if i'm a good luck charm, but it's nice to witness

it all. today in the press conference mike shanahan was asked how quickly after that cowboys win did you start thinking about the seattle seahawks? he's like i celebrated for two or three hours. give the guy a break. mike shanahan has been an nfl head coach for two decades. he has playoffs, super bowls to his resume but he's never led a 3-6 team to seven straight wins to capture a division title, then again no coach in the current postseason format has. the skins stand alone and they will stay standing at least one more week, plenty of big performances to get them to this point. perhaps none big are than alfred morris last night -- bigger than alfred morris last night 2 , hundred yards on 33 carries, three touchdowns, breaking clinton portiss rushing record by nearly 100 yards. it's the skins first division crown since 1999, a proud moment for redskins nation as well as the head coach who always believed it was possible. >> it's so rewarding to come in and trying to put something

together and seeing the guys so excited, the coaching staff so excited. it's what you work for and to see guys working for the last three years 18 hours a day in the draft room looking at pro players, eye vaulting these guys, signing these pay -- evaluating these guys, signing these guys and seeing a lot of guys making different steps, learning the offense, defense, actually stepping up and accomplishing something, you feel very good about. it. >> a winning streak can be traced back to the steady improvement on defense, 15 turnovers in the past seven games. last night they intercepted tony romo three time, much like on thanksgiving. the final pick came by rob jackson on dallas' second to the last possession of the game. the skins finished the season second in turn jove margin in the nfl. the win over the cow -- turnover margin in the nfl. the win over the cowboys especially sweet for a redskin that used to wear the cowboys helmet. >> i probably want the win more than anybody, man.

we're just under two hours away from the new year on the east coast and celebrations are underway already. it doesn't get any bigger than the party in times square in new york city and that is where fox's craig boswell is live

with the party well underway. hi, craig. >> reporter: good evening. it has been underway here for quite some time. this crowd began streaming into times square about 3:00 this afternoon getting the best possible viewing point. there is an absolute sea of people. we're here between 46th and 42nd and up towards central park, all these eyes trained on the world famous new year's eve ball waiting for that ball to drop. >> five, four, three, two, one. >> reporter: the crystal encrusted ball hoisted high above the crossroads of the world with just hours to go until 2013. >> happy new year! >> reporter: revelers have come from across the country and around the world. security is tight and they're packed shoulder to shoulder in times square to see the famous ball make its plunge at midnight eastern time.

closest friends and this crowd is of one mind here, really ready to get go of 2012 and bring in 2013 and everyone here says the same thing over and over believing this will be indeed a lucky year. we all hope. so happy new year, maureen, back to you. >> thank you. quick question, you mentioned security of pretty tight. have new york officials done anything specific considering the threats in the past? >> reporter: of course. they always do specific and you kind of broke up there a little. security is always tight. there's thousands of officers both plainclothes and uniformed officers and people on the roofs. this is well covered. this crowd has probably never indeed felt safer. they've got it well under control because you can probably see all the viewing areas where they have people kind of into their own areas. so it's very well controlled. >> craig boswell in times square, thank you and happy new year again to you. >> reporter: you, too. how are you ringing in the new year?

some people are going to the family friendly events first night in alexandria, virginia, which offers food, fun, music and a fireworks show. fox 5's lauren demarco is live there for all the fun. >> reporter: well, it's no times square, but old town, alexandria certainly is hopping tonight, plenty of folks out here, really fun atmosphere. everybody is just in the mood waiting to ring in the new year. with -- we spoke with some of the organizers and with some folks in the street about what they are planning for 2013. first night alexandria now in its 18th year. vice mayor carey donnelly says it's the largest family friendly new year event in the region. >> we're expecting between 20 and 25,000 people. >> reporter: from food trucks to face painting and balloon animals. venues across old town host events including dozens of musical performances. >> we've got rock and roll

bands, the grandsons and bill crichner is here as well as the stairwells, anarch an acappella group. my new year's resolution is to build a fantastic future for my wife. >> we're just trying to be more active. so we're runners and looking to have more races in the new year. >> reporter: you guys may recognize this gentleman, our movie reviewer kevin mccarthy. >> hello, lauren. how are you? >> reporter: what's your resolution? >> honestly? i want to make more movies with my buddies. we made a movie for steven spielberg this year. we sent it off to him and we're going to make more movies this year is my goal. >> reporter: the countdown to midnight in alexandria takes place on the waterfront, community members welcoming in 2013 with a bang.

it starts here at 11:00. might not seem very cold out there, but spend enough time waiting for new year's outside and you'll need to warm up. let's get a check on just how chilly this new year will be with fox 5's gary mcgrady in the weather center. >> i was out earlier. it's not too bad. the wind is not a problem. it could be a whole lot worse than the 40 degrees it is now at 10:00, 10:20 on new year's eve. let's show you the temperatures the way they stand now, right around 40. i would imagine where lauren was down there first night it's probably 41, 42 and that's not bad. you start drifting out into the western suburbs, manassas, you guys have dropped to 32, culpeper 32. that's definitely the trend here where the colder temperatures are going to be old west and southwest and a little warmer for winchester, martinsburg, for hagerstown. i suspect there's a little thicker cloud deck and there might be just a little more wind, not much more, but just a little bit more wind and i do suspect that the wind overnight

tonight is not a problem. we're only anticipating westerly winds at about 5 miles per hour or so and i just checked. the wind here was at 6 miles per hour and the wind chill factor was only down into the middle 30s. so all things considered not too bad. we're just going to have cloudy skies. out in the suburbs temperature will be plus or minus a degree or 2 , right around 30 degrees or so. tomorrow expect a lot of clouds. there's a chance of a flake or a chance of a sprinkle, but not much more than that. if you liked today, you'll like tomorrow. first look at your forecast for 2013 is all coming up in a few minutes. i guess you could call this the last cast of 2012. >> i seem to share it with you every single year. >> that's right because, you know, special people hang out with each other on new year's eve. so there you go. >> love. thank you, gary. speaking of love, are you looking for love in the new year or maybe a little lust?

maryland. maryland same sex couples have been allowed to get a marriage license since early december. however, they do not take effect until tomorrow. during this year's election nine states and the district of columbia approved same sex marriage. secretary of state hillary clinton is spending her new year's eve in the hospital. she was admitted yesterday after doctors found a blood clot in her head. fox's david lee miller has the latest. >> reporter: secretary of state hillary clinton remains hospitalized after the discovery of a blood clot sunday. doctors found the clot during a followup exam for a concussion she sustained earlier this month. secretary clinton is under observation at new york presbyterian hospital through tuesday where she's being treated with blood thinners. the state department releasing a statement saying in part, "her doctors will continue to assess her condition including other issues associated with her concussion. they will determine if any further action is required." medical experts say the seriousness of a blood clot depends where it is. >> with the previous head trauma may make her at risk for

developing a bleed in her head because they're thinning out her blood. it is classic and a very smart move to bring her into the hospital and observe her carefully. >> reporter: the top u.s. diplomat was expected to return to work this week after being sidelined by a stomach virus which left her severely dehydrated, but she suffered the concussion after fainting due to the dehydration. secretary clinton's illness forced her to cancel some overseas trips and her plans to testify in front of congress december 20th in connection with the deadly attack on the u.s. consulate in benghazi. secretary clinton's top two deputies testified in her place. secretary clinton has stressed she remains ready to testify before she steps down from her post next month. in new york david lee miller, fox news. former president george h.w. bush is reportedly improving after spending a few days in intensive care. the elder bush has been moved out of the icu now that doctors got his fever to come down. he's been in the hospital in houston since the day after

thanksgiving. he was originally admitted with what's described as a bronchitislike cough, but he developed a fever last week. mr. bush is 88 years old. a new year is around the corner along with a host of new laws and changes. a number of new laws take effect across the country at the stroke of midnight tonight, many of them serious, others somewhat peculiar. fox's phil keating has the story. >> reporter: when the ball drops in times square, a host of new laws will take effect across the country. gay couples in maryland will be able to tie the knot legally. nine states and the district of columbia have now legalized same sex marriage. maryland is the first state south of the mason dixon line to make gay marriage legal. workers in two more states can say no to bosses demanding access to their social media accounts like facebook or twitter. laws in california and illinois are taking effect making it illegal for employers to make workers give access to their password protected social

networking accounts. hundreds of thousands will ring in the new year with more money in their paychecks. 10 states across the country are raising the minimum wage for 2013. most of the pay bumps come from state cost of living adjustments that account for inflation. washington state will still hold the title of having the highest minimum wage in the country at $9.19 an hour. that's after the 15-cent new year bump kicks in. no more hogs running wild in kentucky, a new law in that state will make it illegal for residents to release feral or wild hogs back into the wild. keep those swamp buggies off the road in florida. as of tomorrow the state of florida no longer recognizes the all terrain big emergencies as motor vehicles. in miami, happy new year! phil keating, fox news. people in western north

carolina are waiting to see if a bizarre new year's tradition will continue tonight. the organizer of the annual possum drop won't say whether he will lower a live possum at midnight. the town hosted a possum drop for years using a possum in a see-through box adorned with tinsel, but this year peta filed a lawsuit over. it the organizer said he may use a stuffed possum or just defy the court's order. residents of easton, maryland will watch the crab drop tonight. the handmade metal crab dropped at 9 9:00 for the kids and it will drop at 12:00 again for the adults. on baltimore's inner harbor crews worked around the clock to set up the annual fireworks display. the display will light up the harbor at midnight. two warnings are packed with thousands of shells. people will be able to see the fireworks wherever they are around the harbor. coming up it may be the end

wanted to get in here for a good spot to look up at the world famous new year's eve crystal ball and to be one of the first to see that drop in person. look, it goes up about another 12 blocks towards the park and it's nothing but people as far as the eye can see. >> when people are coming into that area, was it easy to get in or did people camp out overnight just to be able to get into that spot? i wonder because a couple years ago my family was sort of kept out from where they wanted to be. >> reporter: right. the answer is no and no. certainly they didn't camp out overnight and no, it wasn't easy to get in. there was a long line of people. you got to get checked on the way in, but everyone was pretty cool about it with the police because you got to have your bags searched. there's no alcohol allowed in and they're real serious because they want this to be the safest place possible. it appears they do that year after year after year of they've got this down in new york city and this crowd really does feel like they are in unison here tonight.

the weekend. long range it looks like the game for fedex sunday with the seahawks is going to be nice and dry. at least that's the way it looks now, but it will be on the chilly side. 34 gaithersburg, 38 baltimore, 44 degrees for quantico. 2013 starts chilly, right around 40 tomorrow and we'll probably be a degree or 2 shy of 40 for the next several days for high temperatures. cincinnati right now is 34. i did check up in manhattan. the temperature was sitting at 36 degrees for central park. i'm sure it's probably right this there for times square as well. really, really cold temperatures. as a matter of fact, i can't remember the last time i saw this kind of cold temperatures coming into the northern areas of the united statesful fargo minus 5, international falls, super cold at minus 14. that's the leading edge of a little bit of arctic air which is going to start coming down. now it is just going to touch us. i think more than anything, it's going to bring our lows down to the 20s several nights

this week and keep us only in the upper 30s to right around 40 degrees or so for highs. if you get way down to the southeast, it's still nice down through the southeastern states, new orleans 61 to bring in the new year, tampa 60 degrees and san diego way out on the west coast right now is 53 degrees. we've had a couple little showers move through today, but it hasn't been a big deal. i think that's probably going to be the case as we head into tomorrow as well. there is a pretty decent moisture fetch coming from west to east here, but what we've seen is this has gotten closer to us. it's just weakened and fallen apart and pushed down to the south of -- south. that's i believe the case for tomorrow as well. tomorrow it's cloudy, chilly, temperatures in the 30s. as we progress through the day, futurecast does not show anything in the way of precipitation, but with that in mind i think we could at least see maybe a snowflake, a flurry
